Public Monitoring of the Decisions of the High Qualification Commission of Judges of Ukraine, the High Council of Justice, and the Opinions of the Public Integrity Council Based on the Results of the Qualification Assessment of Judges and Judicial Candidates


During the second half of 2019, the Institute conducted an expert study and comprehensive monitoring of the practice of the HQCJ, decisions of the Supreme Judicial Council and the Supreme Judicial Council regarding the procedures for the qualification assessment of judges.

The purpose of the study was to:

1. Assess the effectiveness of existing tools used to determine the compliance with office of judges appointed (elected) prior to the introduction of amendments to the Constitution of Ukraine on justice, as well as to verify the ability of candidates for judicial office to administer justice.

2. Analyze the effectiveness of integrity verification mechanisms applied in the procedures for the selection and evaluation of judges.

3. Develop recommendations for improving the regulatory framework and the operational practices of bodies responsible for the selection and evaluation of judges.

Based on the results of the study, the Institute's experts prepared an Analytical Report, which outlines key issues and challenges related to the qualification assessment procedure. The document also offers recommendations for all authorized entities to improve the efficiency and transparency of the judicial assessment procedures.

1. Why was it important to conduct a study of the practice of qualification assessment of judges?

The study identified key problems in existing procedures and determined how effectively the tools for selecting and evaluating judges are working.

2. Which bodies were covered by the monitoring?

The monitoring included an analysis of the practice of the HQCJ, decisions of the Supreme Judicial Council and the Supreme Judicial Council, which play a key role in the processes of selection and evaluation of judges.

3. What was the main result of the study?

The main result was an Analytical Report, which contains a description of the identified challenges and a set of recommendations for improving qualification assessment procedures.

4. How can the results of the study influence the reform of the justice system?

The proposed recommendations are aimed at increasing the efficiency, transparency, and trust in the procedures for selecting and evaluating judges, which is an important element of judicial reform.
